The Annex 2001 and its related implementation Agreements have been created to take protective steps to avoid potential conflicts and shortages and to protect the Great Lakes environment for the future.
What is the Annex?
The Great Lakes Charter Annex 2001 (or the Annex) is an agreement signed by all eight Great Lakes Governors as well as the Premiers of Ontario and Quebec in 2001 to help protect, conserve, restore and improve the Great Lakes Basin for future generations. The Annex was created in recognition that there were many threats to the waters of the basin and that these threats would only increase over time. It was the Sault Ste. Marie Nova Group proposal in 1998 to export water to Asia which brought attention to the need to set standards through the Annex in order to avoid conflicts and water shortages in the future and to protect the existing resources and related ecosystems.
How does the Annex relate to these meetings?
Creation of the Annex was the first part of a two-step process. The Annex took an important first step by setting out principles by which the states and provinces would act together to protect the Great Lakes from diversions and withdrawals. After signing the Annex, the Governors and Premiers identified a second step, which was to implement the Annex principles through agreements amongst the states and provinces which set standards and processes for making mutual decisions about allowing or denying proposals. This interest culminated in the creation of the two “implementing” agreements, the Great Lakes Sustainable Waters Resources Agreement (for Canada) and The Great Lakes Basin Water Resources “Compact” (for the U.S.).
Meetings are being held on both the Canada and U.S. side of the basin to gather public input into the proposed Agreements. This input is being collected within a 90-day comment period which will close on October 18, 2004.
What issues do the Annex and the implementing Agreements address?
Primarily, the Annex applies to new or increased water withdrawl proposals from the Great Lakes by examining their: environmental harm, conservation measures and return flow to the basin, and overall improvements to the basin. Currently, all diversions out of the Great Lakes basin are banned in Canada. This is not so in the U.S.
The implementing agreements deal with bi-national assessments and decision-making of water withdrawal proposals, enforcement of the agreements, public involvement in proposals, and exceptions to water withdrawals.
It is hoped that the legally binding nature of the Agreements will strengthen environmental protection of the waters in the Great Lakes basin.
Who has been involved so far?
According to the Council of the Great Lakes Governors literature, the following groups have been involved: The Council of Great Lakes Governors (governors of the eight Great Lakes states), the staff of the Governors and Premiers of Ontario and Quebec, stakeholders from the agricultural, industrial, shipping, municipal and environmental sectors as well as Tribes and First Nations.
How can you participate?
Meetings: Information meetings are happening across the basin. In Sault Ste. Marie, the meeting is scheduled for Tuesday, September 14, 2004 at the Algoma Water Tower Inn, 360 Great Northern Road, Courtyard Room from 7 to 9 pm.(time and location TBA). The meeting will be facilitated by the Ministry of Natural Resources and the Ministry of Intergovernmental Affairs.
Submission of Comments: Comments may be submitted via email to the Annex 2001 Implementing Agreements site: Annex2001@cglg.org. This is a good venue to have your voice heard.
