Whose vision rules? Ontario Municipal Board's or Grey County and its Residents'? and Can Municipalities protect their water? Grey Association for Better Planning, a county-wide citizen's group in Grey county, is making a motion to the Ontario Superior Court of Justice Divisional Court for leave to appeal two errors of law made by the Ontario Municipal Board (OMB) and for an extension of time to bring the motion. The questions of law are:
- Is "water taking" a use of land within the meaning of the Planning Act and thus prohibited by the Artemesia Township Zoning By-law?
- Does the existence of a Permit to Take Water under the Ontario Water Resources Act override the Ontario Municipal Board/municipality obligation under the Planning Act?
On Friday, February 8, 2002 from 1:00 pm to 3:00pm at the Old Court House in Owen Sound, 595-9th Ave., GABP will argue that this case involves important issues of law, of interest to every municipality in Ontario. In fact, the Association of Municipalities of Ontario (AMO) recently set up a task force to investigate these questions. This session is open to the public and it is expected that many interested parties will be in attendance.
GABP was incorporated in 1990 to promote good land use planning in Grey county and its municipalities. Since that time, the association has worked with the province, the county, municipalities and local associations to develop consensus on a vision for the future economic and environmental health of the county. In good faith many township residents participated in public forums and lent their expertise on local situations towards development of an Official Plan for Grey County. The GCOP received final approval through the OMB in 1999.
The ink was not even dry when a proposal was put before Artemesia Council which ran counter to the vision so carefully prepared, and approved by the province. For three years residents have stood with their township and county to prevent this proposal from undermining the economic and environmental health of their community. Until the OMB decided in March, July and October 2001 to ignore the GCOP and allow the proposal!
This is the first time GABP has undertaken such action. For 12 years GABP's focus has been on workshops, newsletters, assisting residents and municipalities, not on fundraising. Faced with this serious financial/legal undertaking, GABP has made an appeal to the community at large and has received generous support. The "fun" raising is just beginning, though. Several events are planned for Grey County and possibly Toronto.
